Why This Notice? Before adoption of the 2040 Comprehensive Plan, Minnesota Statute requires the City to hold a public hearing. The City Council held public hearings about the proposed 2040 Comprehensive Plan update in May 2018. Since that time, the city distributed the draft 2040 Comprehensive Plan to adjacent jurisdictions and other government agencies as required by State Law for their review and comment. The City has made minor changes to the draft 2040 Comprehensive Plan to reflect many of those comments and suggestions. 

The Planning Commission will hold a public hearing on the updated Draft 2040 Comprehensive Plan, take comments about the proposed 2040 Comprehensive Plan and will be making a recommendation about the proposed 2040 Comprehensive Plan to the Lake Elmo City Council. The City Council makes the final decision about adopting and approving the proposed 2040 Comprehensive Plan for the City.

Subd. 2. Existing Street Name. The term existing street name shall mean the name by which a street is designated on the Boulder Ponds 3rd Addition Plat. 

Subd. 3. New Street Name. The term new street name shall mean the name by which a street shall be known from and after the effective date of this ordinance.

SECTION 3. The Existing Street Name of Jade Trail N. as designated on the Boulder Ponds 3rd Addition Plat shall have a New Street Name of 7th Street N.

SECTION 4. The adjustment shall not affect the entire length of Jade Trail N. The section which will be renamed is further described as between 5th St. North and Jade Cove North and is shown in Exhibit A.

SECTION 5. Effective Date. This ordinance shall become effective immediately upon adoption and publication in the official newspaper of the City of Lake Elmo.

SECTION 6. Adoption Date. This Ordinance 08-218 was adopted on this 2nd day of January 2019, by a vote of 5 Ayes and 0 Nays.

SECTION 1. The City Council of the City of Lake Elmo hereby renames Stillwater Boulevard:

SECTION 4. The adjustment shall not affect the entire length of Stillwater Boulevard. The section which will be renamed is further described as North of the realigned Stillwater Boulevard/CSAH 14 and West of the realigned Stillwater Boulevard/CSAH 15 and is shown in Exhibit A. 

SECTION 5. Effective Date. This ordinance shall become effective immediately upon adoption and publication in the official newspaper of the City of Lake Elmo.

The area proposed to be assessed for such improvements includes those properties in Sections 8, Range 21 West, Township 29 North, abutting the streets noted above, all within City of Oakdale, Washington County, Minnesota. The project has an estimated total project cost of $2,748,000. A reasonable estimate of the impact of the assessment will be available at the hearing. Such persons as desire to be heard with reference to the proposed improvement will be heard at this meeting. 

PROPOSED ASSESSMENT. The proposed assessment roll is on file for public inspection at the City Clerk’s office. The total amount of the proposed assessment for the project is $1,128,519. Written or oral objections will be considered at this hearing. A reasonable estimate of the impact of the assessment will be available at the hearing. 

PREPAYMENT. Property owners may, at any time prior to certification of the assessments to the County Auditor as of November 15, 2019, pay the entire assessment to the City of Oakdale. (Interest, at a rate not to exceed 4%, shall be charged after October 15, 2019). Property owners may, at any time thereafter, pay to the City of Oakdale the entire amount of the assessment remaining unpaid. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. The first of the ten installments will be payable with the general taxes collectible in 2020. Interest shall be added to each subsequent installment when due for one year on all unpaid installments. Property owners have the right to partially prepay assessments consistent with Chapter 2, Article VII of the Code of Ordinances. If property owners decide not to prepay assessment before the date stated above, the proposed assessment will be levied consistent with the interest rate and installment information provided to each property owner. 

APPEALS. Appeals must be in the form of a signed, written objection filed with the clerk prior to the hearing or presented to the presiding officer at the hearing. The City Council may upon such notice consider any objection to the amount of a proposed individual assessment at an adjourned meeting upon such further notice to the affected property owners. An owner who has submitted a written objection may appeal an assessment to District Court pursuant to Minnesota Statutes Section 429.081 by serving notice of the appeal upon the Mayor or Clerk of the City within 30 days after the adoption of the assessment and filing such notice with the District Court within ten days after service upon the Mayor or Clerk.
