Right to disconnect: Romanian employees do not have to answer the phone after work. What news is coming out

Following the French model, the European Commission wants to regulate employees’ right to severance at the level of all member states.

In Romanian, employees, including those from Romania, no longer have to answer phone, email or voicemails after leaving work.

The new directive is due to be put up for public debate this autumn.

Frighteningly, in some companies here, the right to disconnect allows employees to not answer work emails or phone calls outside of work hours.

The European Commission is working on a new directive setting working hours and rest periods. In addition, employees are not penalized if they do not perform various work tasks after a certain time. Instead, MPs feel that those who work more hours should be financially compensated.

Dragos Bislaru, MEP: ”Problem is, I shouldn’t be emailing after 9pm, and two, I shouldn’t have to wait for them to respond to me outside of business hours. If there’s a fact that somehow in the job description they have to decide… somehow they have to put in more hours, the job description has that quality of work – obviously, compensation for this type of availability has to be negotiated.“.

Most likely, in the autumn of this year, the Commission will finalize the legislative act, which must be approved by the two decision-making bodies, the Parliament and the European Council. It is a long process, and Romanian representatives hope that a definitive decision will be made by the new parliament elected next June.

France was the first European country to regulate the right of employees not to be permanently attached to work matters. Countries like Italy, Spain or Belgium followed the French example.

Free time and homework

Belgians working in companies with more than 20 people can switch off their work phones without penalty. In our country, employers and trade unions are working on an agreement on the digitization of working conditions.

Florin Giannu, Head of Small and Medium Enterprises: ”This is the advantage of flexibility – we no longer have to look at the program as a fixed hour, a different allocation – this time we saw it as a measure, salary benefits among employees are not important, but this resource is called time. – Time has become the most valued resource by employees, when they have free time at their disposal or create this trade-off between work and personal life.“.

Oana Botolan, Human Resources Specialist: ”In IT, through the lens of job requirements, there is this practice, which is called on-call – all companies use it – as long as the employee is available, he does not need to work, only available when needed – the employee is paid and given a substantial amount.“.

The order will also regulate housework. Rest and rest periods will be fixed. HR experts say this type of activity allows companies to save money, and the remaining money can be used for various benefits offered to employees.
